You may then scroll through the table of contents of the application as well as its appendices and select the information you wish to review. (Note: The standard county forms regarding the application are the first several pages immediately after the title page and also in Appendix 13.)

Special Use Permit Process (and “where we are” in the process):

  1. Applicant files application
  2. Planning Department Reviews for completeness
  3. Applicant prepares copies of application for the agency review
  4. Agency Review - Each agency reviews the application and responds to the Planning Dept. with comments or recommendations (the agencies reviewing the application include: Dept. of Health, Maui; DOT, Statewide Planning Office; Dept. Land and Natural Resources; State Historic Preservation Division, DLNR; DBEDT, Office of State Planning; Maui Electric Company; Dept. Public Works and Env. Mgmt.; Dept. Water Supply; Fire Dept.; Police Dept. Natural Res. Cons. Serv.; U.S. Army Corp of Engineers).
  5. Planning Department Review - The department reviews agencies comments and may request responses from applicant.
  6. Planning Department Report - The department prepares a report to be submitted to the decision makers.
  7. Notice of Hearings - As required by rules, Applicant will notify residents within 500 feet of the project of the hearing; separately, the Planning Department will notice the hearings as required by law.
  8. Hana Advisory Committee Hearing - The HAC will hear the Planning Department's recommendation, take testimony from the public, and have the applicant explain the project and answer questions at a hearing; the HAC will deliberate and issue a recommendation to the Maui Planning Commission.
  9. Maui Planning Commission Hearing - At a noticed public hearing, the MPC will review the recommendation of the HAC and vote on the application.
